PROBATE PROCESS

JAG Realty manages the probate process by being granted the authority to list. The agent who is listing a probate sale must be an expert in the demands of the Probate Real Estate Process. JAG Realty offer these such expertise:

  • Probate Forms

  • Experience in Selling Property with court confirmation

  • Lining up over-bidders after an acceptance

  • Selling within 90% of the appraised value

  • Desk Top Appraisals

  • Investigate the chain of title to make sure it is clear of encumbrances

  • Verify the executor/ trustee transfer of property within terms of probate//trust

  • Investigate Vesting properly

  • Provide Vendor Repair services upfront that will provide the Estate with the highest return, with vendor payment deferred until close of escrow

RECEIVING AUTHORITY TO LIST: FULL OR LIMITED AUTHORITY

JAG Realty must be granted authority to list either by Full or Limited Authority.  Full authority grants executors or administrators the ability to act on behalf of the estate with far less supervision. Limited Authority, however, requires more supervision and oversight from the court, including additional court hearing to allow for overbids.

OPEN ESCROW WITH A PROBATE SALE

Once escrow is opened, we make sure that the buyers are fully vetted and ensure our projected close date meets with our Estate goals.  We verify Loan Approvals, Proof of Funds, and remove buyer contingencies in a timely manner.  During limited authority, an additional court date is required for the opportunity of over-bidders.  JAG Realty continues to advertise the property for the opportunity to generate overbids.
